Welcome to PLUTOE . These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and services (collectively, the "Platform"), including any purchases made through the Platform.

By accessing or using our Platform, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Platform.

These Terms are published in accordance with the provisions of the Information Technology Act, 2000, the Consumer Protection Act, 2019, the Consumer Protection (E-Commerce) Rules, 2020, and other applicable laws of India.


1. Account Terms

1.1 To make a purchase or access certain features of the Platform, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

1.2 You must be at least 18 years of age to create an account and make purchases on the Platform. If you are under 18, you may only use the Platform under the supervision of a parent or legal guardian who agrees to these Terms on your behalf.

1.3 You are responsible for maintaining the confidentiality of your account login credentials and for all activities that occur under your account. You agree to notify us immediately at plutoe.biz@gmail.com of any unauthorized use of your account.

1.4 We reserve the right to suspend or terminate your account at our discretion if we suspect fraudulent activity, a breach of these Terms, or any misuse of the Platform.

2. Pricing and Payment

2.1 All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST), unless stated otherwise.

2.2 We reserve the right to change prices for products at any time without prior notice. The price applicable to your order will be the price displayed on the Platform at the time you place the order.

2.3 We accept payments through the payment methods listed on the Platform at checkout, which may include credit/debit cards, UPI, net banking, and other methods facilitated by our third-party payment gateway partners.

2.4 All payments are processed securely through third-party payment gateways. We do not store your complete card or banking details on our servers.

2.5 In the event of a pricing error displayed on the Platform due to a technical glitch or human error, we reserve the right to cancel the order and issue a full refund, even if payment has already been processed.

2.6 Cash on Delivery (COD), where offered, may be subject to additional verification, COD charges, or order value limits as specified at checkout.


3. Product Descriptions

3.1 We strive to ensure that product descriptions, images, pricing, and availability displayed on the Platform are accurate. However, we do not warrant that product descriptions, colors, or other content available on the Platform are completely accurate, error-free, or free of typographical mistakes.

3.2 Product colors may vary slightly due to photography, lighting, and individual device screen settings.

3.3 Sizing charts are provided for guidance only. We recommend reviewing the size guide carefully before placing an order, as minor variations may occur due to manual measurement processes.

3.4 If a product you have ordered is found to be materially different from its description, you may be entitled to a return or refund in accordance with Section 6 (Returns and Refunds) below.

3.5 We reserve the right to limit the quantity of products purchased per customer, per household, or per order.


4. Order Acceptance

4.1 Placing an order on the Platform constitutes an offer to purchase the relevant product(s). All orders are subject to acceptance and availability.

4.2 We reserve the right to refuse or cancel any order for reasons including, but not limited to: product unavailability, errors in pricing or product information, suspected fraudulent activity, or issues identified with your account or payment.

4.3 If we cancel an order after payment has been made, we will issue a full refund to your original payment method within 7 business days.

4.4 You will receive an order confirmation via email/SMS once your order has been placed. This confirmation indicates that we have received your order but does not constitute acceptance of your order. Acceptance occurs when we dispatch the product(s) to you.


5. Shipping and Delivery

5.1 We aim to process and ship orders within 7 business days of order confirmation, unless stated otherwise on the product page.

5.2 Estimated delivery timelines will be provided at checkout and/or in your order confirmation. These are estimates only and actual delivery times may vary due to courier delays, weather conditions, regional restrictions, or other factors beyond our control.

5.3 Shipping charges, if applicable, will be displayed at checkout prior to order confirmation.

5.4 Risk of loss and title to products pass to you upon delivery to the shipping address provided at checkout.

5.5 It is your responsibility to ensure that the shipping address and contact information provided are accurate and complete. We are not responsible for delays or non-delivery resulting from incorrect address information provided by you.

5.6 In the event a shipment is delayed, lost, or undelivered due to courier issues, please contact us at plutoe.biz@gmail.com so we can investigate and assist you.


6. Returns and Refunds

6.1 We want you to be satisfied with your purchase. Please review our RETURN POLICY for detailed information on eligibility, timelines, and procedures.

6.2 Unless otherwise specified on the product page, items may be returned within 7 days of delivery, provided they are unused, unwashed, and in their original condition with all tags and packaging intact.

6.3 Certain items (such as innerwear, customized products, or items marked "Final Sale") may not be eligible for return due to hygiene or customization reasons. Such exclusions will be clearly indicated on the relevant product page.

6.5 Once a returned item is received and inspected, we will notify you of the approval or rejection of your refund. Approved refunds will be processed to your original payment method within 7 business days.

6.6 In the case of damaged, defective, or incorrect products received, please contact us within 3 days of delivery with photographic evidence, and we will arrange for a replacement, repair, or refund as appropriate.

6.7 Return shipping costs, unless the return is due to our error (wrong/defective product), may be borne by the customer.


7. Prohibited Uses

You agree not to use the Platform to:

7.1 Violate any applicable Indian law, rule, or regulation;

7.2 Engage in any fraudulent activity, including using stolen payment information or making fraudulent claims for refunds;

7.3 Upload, post, or transmit any content that is unlawful, defamatory, obscene, infringing, or harmful;

7.4 Attempt to gain unauthorized access to our systems, servers, or networks, including through hacking, phishing, or introducing malicious code;

7.5 Use any automated means (such as bots or scrapers) to access or extract data from the Platform without our prior written consent;

7.6 Resell products purchased from the Platform for commercial purposes without our prior written authorization;

7.7 Impersonate any person or entity, or misrepresent your affiliation with any person or entity;

7.8 Interfere with or disrupt the security, integrity, or performance of the Platform.

We reserve the right to suspend or terminate access to the Platform, cancel orders, and/or pursue legal remedies against users who violate these prohibited uses.


8. Intellectual Property

8.1 All content on the Platform, including but not limited to logos, trademarks, product designs, images, text, and graphics, is the property of PLUTOE or its licensors and is protected under applicable Indian intellectual property laws.

8.2 You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without our prior written consent.


9. Limitation of Liability

9.1 To the maximum extent permitted under applicable Indian law, PLUTOE shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform or products purchased through it.

9.2 Our total liability to you for any claim arising from your use of the Platform or any product purchased shall not exceed the amount paid by you for the product(s) giving rise to the claim.

9.3 Nothing in these Terms shall be construed to limit or exclude our liability for fraud, willful misconduct, or any liability that cannot be excluded or limited under applicable Indian consumer protection law.

9.4 We are not liable for any delay or failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, strikes, courier disruptions, government action, or technical failures (force majeure).


10. Indemnification

You agree to indemnify and hold harmless PLUTOE, its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your breach of these Terms, your violation of any law, or your infringement of any third-party rights.


11. Grievance Redressal

In accordance with the Consumer Protection (E-Commerce) Rules, 2020 and the Information Technology Act, 2000, any grievances regarding products, services, or these Terms may be addressed to our Grievance Officer:

We will acknowledge and address grievances within the timelines prescribed under applicable Indian law.


12. Changes to These Terms

We reserve the right to modify or update these Terms at any time. Changes will be effective immediately upon posting to the Platform with a revised "Last Updated" date. Your continued use of the Platform after changes are posted constitutes your acceptance of the revised Terms.


13. Governing Law and Jurisdiction

13.1 These Terms shall be governed by and construed in accordance with the laws of India.

13.2 Any disputes arising out of or in connection with these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.

13.3 Nothing in this Section shall restrict your right, as a consumer, to approach the appropriate consumer forum or authority under the Consumer Protection Act, 2019, in the jurisdiction where you reside or where the cause of action arose.
